MVD Request for Hearing Form

If you have been arrested for a DWI in New Mexico, you have 20 days from the date of arrest to request an MVD hearing to contest the revocation of your driver's license. Missing this deadline means your license is automatically suspended. The deadline is absolute.

When filling out the form, check the box requesting that the officer be present at the hearing. Include a $25 check or money order payable to the Motor Vehicle Division. Send the form by certified mail with return receipt so you have proof it was received.

Why the MVD Hearing Matters

After a DWI arrest, there are two separate proceedings: the criminal case in court and the civil license revocation administered by the Motor Vehicle Division. The MVD hearing is your one chance to challenge the revocation before it takes effect. Even if the hearing is not won, it generates valuable information, including the arresting officer's testimony under oath, that can be used in the criminal case.
